Terms & Conditions
By placing an order with Hearth Baking Co., you agree to the terms below. Please read them alongside our Refund & Cancellation Policy, which is part of these Terms.
01 About Our Kitchen
Hearth Baking Co. is a home-based cottage food business in Texas. Everything is baked by hand in a private residence, in small batches.
This product was produced in a private residence that is not subject to governmental licensing or inspection.
This disclosure also appears on every package, as Texas cottage food law requires.
02 Ordering
We offer two order lanes. Full details live on the Personal Orders and Catering pages; the key terms are:
An order is confirmed once payment is received. Until then, dates and availability aren’t held.
03 Pricing & Fees
All prices are in U.S. dollars. Personal Orders add a delivery fee and Catering adds a service fee; both are shown before you pay, never after. Texas sales tax is not applied to our baked goods. We may adjust prices over time, but the price shown when you confirm your order is the price you pay.
04 Payment
Personal Orders are paid in full at checkout. Catering is paid in full at scheduling. Payments run through our website’s secure processor — we never see or store your card details.
05 Allergens
Our kitchen is always peanut-free and tree-nut-free, with coconut as the only exception. It also handles gluten, dairy, eggs, and soy. Our gluten-free, dairy-free, and egg-free options are made with careful cross-contact prevention, but not in a dedicated allergen-free facility. If you have a severe or anaphylactic allergy, please contact us before ordering so we can talk it through honestly. Every order requires an allergen acknowledgment at checkout, and our full Allergen Policy explains the steps we take.
06 Delivery & Service Area
Personal delivery covers the neighborhoods within about 30 minutes of Bee Cave — Four Points, Lakeway, Bee Cave, and Westlake — on Wednesday and Saturday mornings. Catering serves locations within 1.5 hours of Bee Cave. You’re responsible for providing an accurate address and someone available to receive the order at the scheduled time. Once we’ve handed off your order, responsibility for it passes to you.
07 Cancellations & Refunds
Cancellations, rescheduling, and refunds are governed by our Refund & Cancellation Policy. Because we bake to order with fresh, perishable ingredients, refund eligibility depends on how much notice we receive.
08 Handmade Products
Everything is made by hand in small batches, so slight variation in appearance, size, and color is natural and part of the charm — it isn’t a defect. We stand behind our freshness and accuracy; see Quality Issues in our Refund & Cancellation Policy.
09 Our Content
The Hearth Baking Co. name, logo, photography, recipes, and website content are ours. Please don’t copy or reuse them without our written permission.
10 Limitation of Liability
To the fullest extent permitted by law, Hearth Baking Co.’s liability for any order is limited to the amount you paid for that order.
11 Governing Law
These Terms are governed by the laws of the State of Texas.
12 Changes to These Terms
We may update these Terms from time to time. The date below shows the current version, and placing a new order means you accept the Terms in effect at that time.
